DownToDash Privacy Policy 2019

Below is our revised Privacy Policy, which has been updated to reflect relationships with partners to manage advertising on other sites and services, discussed in more detail below in Section 1.3 and a newly added Section 4B.

Protecting your privacy is a serious matter and doing so is very important to us. Please read this Privacy Policy statement (the “Policy”) to learn more about our Privacy Policy. This Policy describes the information DownToDash, Inc. (“DownToDash”, “our”, “we”) collect from you and what may happen to that information, and only applies to such information. This Policy applies to all sites under the DownToDash.com domain as well as our platforms, tools, and services (together, the “Platform”).

  1. Information Collection

 

  • 1. We collect the following information about you and your use of our Platform in order to create a better, more personalized experience for you:
    • 1.1. a nickname selected by you or assigned by us, your email address, your profile pictures, your interests, your university/ work, your birth date, your name (if provided) a password selected by you, your zip code; and
    • 1.2. for each DownToDashPlan, Group or DownToDash event Everywhere in which you participate, you may choose to create and store a short description or statement which will be viewed by anyone who is accessing that DownToDash Group or DownToDash plan, and your message board postings.
    • 1.3. for purposes of this Policy, “Personally Identifiable Information” means information that could be used to identify your personally (such as your email address or IP address), which has not been previously or subsequently disclosed by you on the public areas of our website or in messages you send to your DownToDashGroup Mailing Lists or DownToDash plan emails.
  • 2. We automatically track certain basic information about our members (such as internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, click patterns, etc.). We use this information to do internal research on our members’ usage patterns, demographics, interests and general behaviour to better understand and serve you and our community.
  • 3. We currently contract with online partners to help manage and optimize our business and communications. For example, we use the services of partners to help us deliver and measure the effectiveness of our advertising and how visitors use our Platform. To do this, we and our partners use third-party tracking technologies such as web beacons, pixels and cookies on this Platform and on other websites and online services. A “cookie” is a piece of data stored on your computer that is tied to information about you. The type of information collected includes the URL you came from and go to, your browser information, and IP address, and helps us learn how to improve our service. We use these technologies for authentication, tracking user sessions, preferences, and movements around the Platform, anonymous and aggregated marketing analytics, performance analytics, ad retargeting, and tracking aggregate trends on the Platform. No information shared with our partners through cookies and related technologies is directly linked to your Personally Identifiable Information.
  • 4. For our members’ convenience, we also use “cookies” to allow you to enter your password less frequently during a session and to provide for an easier registration process. If you configure your browser or otherwise choose to reject the cookies, you may still use our site. However, to best experience our website and Platform and most easily use our Platform you must have cookies enabled. Our use of cookies is consistent with the rights and restrictions set forth in Section 2.
  • 5. We may collect information such as postings you make on the public areas of our website, messages you send to the DownToDashGroup Mailing List or DownToDash emails, messages you send to us, and correspondence we receive from other members or third parties about your activities or postings on our website. Our use of this information is consistent with the rights and restrictions set forth in Section 2.

 

  1. Use of Information

 

  • 1. We use the information we collect about you (including your Personally Identifiable Information) to create a better, more personalized experience for you based on your individual usage habits, improve our marketing and promotional efforts, analyse site usage, improve our content and product offerings, and customize our site’s content, layout and Services. These uses improve our site and allow us to better customize it to meet your needs. We also use the information we collect about you to resolve disputes, troubleshoot problems, and enforce our Terms of Service Agreement.
  • 2. We may compile the information we collect about you and use it, in an aggregate form only, in the negotiation and establishment of service agreements with public and/or private enterprises under which such enterprises will serve as DownToDash partners or as venues for meetings between our users/ members (“DownToDash”).
  • 3. We may use for promotional, sales or any use that we consider appropriate your correspondence with us or photographs submitted for publication on our website, be it via email, postings on our website, or feedback via the member polls. Our use of such materials is consistent with the restrictions on disclosure of Personally Identifiable Information set forth in Section 3.

 

  1. Disclosure of Your Information

 

  • 1. Opt-in requirement. WITHOUT YOUR AFFIRMATIVE CONSENT (ON A CASE-BY-CASE BASIS), WE DO NOT SELL, RENT OR OTHERWISE SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH OTHER THIRD PARTIES, UNLESS OTHERWISE REQUIRED AS DESCRIBED BELOW UNDER “REQUIRED DISCLOSURES”. TO THE EXTENT WE SHARE INFORMATION WITH OUR PARTNERS AND ADVERTISERS, WE SHARE ONLY AGGREGATED OR OTHERWISE NON-PERSONALLY IDENTIFIABLE INFORMATION THAT IS NOT LINKED TO YOUR PERSONALLY IDENTIFIABLE INFORMATION. Aggregated information that we may share with our marketing partners includes, but is not limited to, information showing the relative popularity of one DownToDash plan/ event/ venue over another, or the popularity of certain DownToDash plans/ events/ topics.
  • 2. You should understand that information you provide through the registration process or post to the public areas of our website, or through the use of our Platform (including your name (if provided) and location information) may be accessible by and made public through syndication programs and by search engines, metasearch tools, crawlers, metacrawlers and other similar programs.
  • 3. Required disclosures. Though we make every effort to preserve member privacy, we may need to disclose your Personally Identifiable Information when required by law or if we have a good-faith belief that such action is necessary to (a) comply with a current judicial proceeding, a court order or legal process served on our website, (b) enforce this Policy or the Terms of Service Agreement, (c) respond to claims that your Personal Information violates the rights of third parties; or (d) protect the rights, property or personal safety of DownToDash, its users, members and the public. You authorize us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us or you to legal liability.

 

  1. Communications from DownToDash and Members of the DownToDash Community

 

  • 1. Communication from DownToDash and Members of the DownToDash Community are governed by Sections 7.1 and 7.2 of our Terms of Service. You may manage your subscriptions to all DownToDash Communications in the Communication Preferences tab of the settings tab on the mobile application page.

4B. Retargeting

  • 2 We partner with third parties to manage our advertising on other sites and services. Our third party partners may use technologies such as cookies and other third-party tracking technologies to gather information about your activities on our Platform to market and advertise our services to you on third party sites and services. For example, third parties that we work with may use the fact that you visited our Platform to target ads for DownToDash services to you on non-DownToDash sites and services.
  1. Reviewing, Updating, Deleting and Deactivating Personal Information

 

  • 1. After registration for our Platform and for specific topic DownToDash Groups or DownToDash plans, we provide a way to update your Personally Identifiable Information. Upon your request, we will deactivate your account and remove your Personally Identifiable Information from our active databases. To make this request, email [email protected]. Upon our receipt of your request, we will deactivate your account and remove your Personally Identifiable Information as soon as reasonably possible in accordance with our deactivation policy and applicable law. Nonetheless, we will retain in our files information you may have requested us to remove if, in our discretion, retention of the information is necessary to resolve disputes, troubleshoot problems or to enforce the Terms of Service Agreement. Furthermore, your information is never completely removed from our databases due to technical and legal constraints (for example, we will not remove your information from our back up storage).

 

  1. Notification of Changes

 

  • 1. If we decide to change this Policy, we will post those changes on https://downtodash.com/privacy/and other places we deem appropriate, so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. We will use information in accordance with the Privacy Policy statement under which the information was collected.
  • 2. If we make any material changes in our privacy practices, we will post a prominent notice on our website notifying you and our other members of the change. In some cases where we post a notice we will also email you and other members who have opted to receive communications from us, notifying them of the changes in our privacy practices. However, if you have deleted/deactivated your account, then you will not be contacted, nor will your previously collected personal information be used in this new manner.
  • 3. If the change to this Policy would change how your Personally Identifiable Information is treated, then the change will not apply to you without your affirmative consent. However, if after a period of thirty (30) days you have not consented to the change in the Policy, your account will be automatically suspended until such time as you may choose to consent to the Policy change. Until such consent, your personal information will be treated under the Policy terms in force when you began your membership.
  • 4. Any other change to this Policy (i.e., if it does not change how we treat your Personally Identifiable Information) will become effective after we provide you with at least thirty (30) days notice of the changes and provide notice of the changes as described above. You must notify us within this 30 day period if you do not agree to the changes to the Policy and wish to deactivate your account as provided under Section 5.

 

  1. Dispute Resolution

 

  • 1. Any dispute, claim or controversy arising out of or relating to this Policy or previous Privacy Policy statements shall be resolved through negotiation, mediation and arbitration as provided under our Terms of Service Agreement.

 

This Privacy Policy is governed by the terms of the DownToDash Terms of Service Agreement, including but not limited to Section 17 of such Terms of Service Agreement.

 

 

Usage and content policies: Rules for using DownToDash

Be Real

DownToDash profiles are intended to represent real people in a local area. DownToDash member profiles must be honest and authentic.

Be Honest: Intentions, Affiliations, Transparency

All members should be open about who they are, their intentions, and their affiliations. All group and event descriptions should be accurate, so members can make informed decisions about their participation.

Be Yourself: Fake Accounts & Impersonation

Creating fake accounts, malicious accounts, or accounts meant to impersonate another person, is prohibited on DownToDash.

Be Respectful

Respecting people’s time, attention, personal choices, and personal boundaries is essential to creating safe and trusting communities. Be respectful in interactions with people and in content posted on the platform. DownToDash monitors and restricts behaviours that are dishonest, undermine the integrity of the platform, violate personal boundaries, or serve to intentionally upset people.

Message Respectfully: Don’t Spam

Content sent to a member that is irrelevant, impersonal, unsolicited, promotional, or repetitive is spam.

Set Appropriate Expectations and Honour Them: Don’t Tamper with Plans, Groups or Events

Converting or changing plans and events in a group or event, so that they no longer align with the expectations and purpose set by the organizer and leadership team, is misleading and not allowed.

The intentions of the plan/ group and event should remain consistent with user/ member expectations as set in the group description.

Converting

Stepping up as organizer to a DownToDash plan/ event in order to change the focus of the plan/ group, to close the plan/ group, to send or post promotional content, or to send or post content not aligned with the original description of the group, is prohibited. If it is your intention to change the meaning or purpose of a plan/ group, we advise that you start a new plan/ group instead. If a group gets a new organizer, the mission of that plan/ group should stay the same. Plans/ Events in a group should reflect intentions expressed in the group description.

Tampering

Altering the content or settings of a group without permission from the main organizer, or in a way that is not aligned with the purpose of that group, is prohibited. Any use of DownToDash tools or features to disrupt the plan, group, event or destroy content for the purpose of undermining or undercutting the established community is a violation of our policies.

Honour Requests for Distance: About Block and Ban Decisions

If you are blocked, you’re blocked. Members must accept and respect any organizer’s decision to ban a user/ member and from a group, or a user/ member’s decision to block a user/ member from contacting them. Creating new accounts to circumvent block or ban decisions is prohibited.

Sexual Content and Nudity

Pornography is not allowed on DownToDash. Publicly shared photos must be appropriate for general audiences. Nude or sexual photos are not allowed in public spaces.

Nudity

If nudity or sexuality is part of a group’s identity or lifestyle, organizers must keep the group Private in order to limit access to this content to members of that group. DownToDash expects leadership teams to monitor this content.

Sex Solicitation and Prostitution

DownToDash prohibits groups that, or individuals who, use DownToDash to proposition for sex, or to promote or engage in prostitution. For policies on groups that may contain such content, please see “Pornography, nudity, or sexual content” and “Mature interests that are not transparent” in DownToDash plans, groups and event policies.

Shocking, Disturbing, and Violent Content

Gratuitously graphic, disgusting, obscene, or violent content is prohibited. We don’t allow content posted to upset, shock, or disturb a DownToDash community or its members.

Child Exploitation

DownToDash has a zero tolerance policy regarding child pornography or anything DownToDash HQ believes exploits, sexualizes, or fetishizes minors. Such content will be removed from the platform and the uploader will be banned. DownToDash reports all child pornography to the National Centre for Missing and Exploited Children (NCMEC).

Ask for Permission: Consent

DownToDash defines consent as welcomed communications and actions to engage with a user/ member. Engaging with anyone in a non-consensual way is strictly prohibited. If ever in doubt, ask permission.

Respect Privacy: Don’t Post Other People’s Private Information

Posting other people’s private information without their explicit consent is prohibited. …

Members and organizers should always be mindful of privacy and use discretion when sharing any private content that belongs to themselves or to other members. For example, phone numbers, social security numbers, addresses, financial information, passwords, and government identification are considered private information.

Be Kind

Bullying, harassment, exploitation, and acts of hate undermine community building in safe spaces where people can trust one another. Building real relationships requires us to be more compassionate and kinder towards one another. DownToDash enforces against behaviours that are threatening, intentionally malicious, or personally harmful–physically, emotionally, or mentally.

Be Compassionate: Don’t Harass, Bully or Shame

Harassment and bullying are not allowed on DownToDash. DownToDash will honour requests to remove content that publicly shames or degrades a private individual.

Members should first contact the uploader or the organizer to request that content be removed.

Harassment is persistent or non-consensual contact from another member. Bullying is the intentional posting of mean content for the purpose of hurting or embarrassing another.

DownToDash will honour requests to remove nude, lewd or shaming photos if the subject of that content reports it. Content targeting a public figure, organization, or anyone who has gained news attention, is not subject to these policies.

Act with Integrity: Do Not Manipulate or Exploit

Any attempt to use someone’s insecurities or vulnerabilities for personal gain is considered manipulation or exploitation and is prohibited.

Hate and Supremacy

Hate speech, supremacy, or behaviours that incites hate or violence against individuals or groups of people based on who they are or their beliefs, is prohibited.

Be Safe

All organizers and members should take ownership over their personal safety and should never put themselves or others in danger. We expect all users, organizers and members to be mindful of local laws when engaging with their groups. Where appropriate, organizers should also set guidelines for their events to ensure their members are participating safely.

No Threats, Violence, or Personal Endangerment

Using DownToDash to promote, facilitate, or organize violent, criminal, or non-consensual actions that endanger anyone, physically, mentally or emotionally, is prohibited.

Credible threats of violence or aggression will be removed and are grounds for removal.

Self-Injury

DownToDash does not allow any content that encourages or glorifies self-injury or encourages others to harm themselves.

Copyright and IP

Intellectual Property

We respect the intellectual property rights of others. Posting content that violates another party’s intellectual property rights is prohibited.

When provided with the requisite information, DownToDash will remove or disable access to material that infringes on the intellectual property rights of others or remove accounts of those who may be repeat infringers. Please note that simply hosting an event around a similar topic in a shared location is generally not considered a violation of our policies.

 

DownToDash is a mobile application for connecting with university students based on common interests and university activities. It works as an icebreaker and is a secure network (students can log in only with their university email address).

When you sign up for DownToDash’s application and use the features and any others that will be rolled out, you will inevitably share some information with us. This can affect your privacy and so we want to inform you about the information we collect, how we use it, whom we share it with, and the choices we give you in collecting your information and how we protect the information. This Privacy Policy is incorporated into and is subject to DownToDash’s Terms of Use. Your use of the DownToDash Site, DownToDash Software and Application (hereinafter ‘app’) and its Service and any personal information you provide on the DownToDash Application remains subject to the terms of this Privacy Policy and its Terms of Use.

Your choices about collection and use of your information

You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our Service because such information may be required in order for you to register as a user and use the app.

Our Service may also deliver notifications to your mobile device. You can disable these notifications by going into “App Settings” on the DownToDash app or by changing the settings on your mobile device.

Information we collect about you

Information you provide: In order to register as a user with DownToDash, you will be asked to sign up using your university email address first and then with your Facebook account. When you sign up with Facebook, you authorize DownToDash to access certain Facebook account information, a few Facebook profile pictures (as available for public viewing), your email address, gender, birthday, university name, nationality and friend list. Your location information is automatically shared with DownToDash. You permit us to collect and store information regarding the interests and activities you choose while utilizing the application. If you chat with other users, you permit us access to details of date, time and the content of your chats. In addition, collection of the log file information i.e our server logs may collect details pertaining to your web request, Internet Protocol (“IP”) address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of your request, one or more cookies that may uniquely identify your browser, (Hereinafter collectively referred to as ‘information’)

Information collected automatically: We automatically collect information from your browser or device when you visit our Service. This information could include your IP address, device ID and type, your browser type and language, the operating system used by your device, access times, your mobile device’s geographic location while our application is actively running, and the referring website address.

Use of technologies to collect information:

We use various technologies to collect information from your device and about your activities on our Service.

Cookies and Use of Cookie Data: When you visit DownToDash application, we may assign your device one or more cookies to facilitate access to our Service and to personalize your experience. Through the use of cookies, we may automatically collect information about your activity on our Service, such as the pages you visit, the time and date of your visits and the links you click.  You can control information collected by the cookies by either deleting or declining cookies in your browser settings. Advertising IDs: If you are using DownToDash application Advertising IDs, instead of cookies, maybe used as a recognition or identification tool to store your preferences and track your use of our application. Advertising IDs can be reset in “Settings” on your iPhone.

How the information collected is used

For DownToDash’s use: We may use information that we collect about you to:

  • Provide and improve our products and services to enhance user experience.
  • Manage your account and provide you with customer support.
  • Perform research and analysis about your use of, or interest in, our or other company’s products, services, or content.
  • Connect with you by email about products or services that may be of interest to you either from us or other third parties.
  • Website or mobile application analytics

With whom we share your information

Information Shared with Other Users: Other DownToDash users will be able to view information on your profile that you have provided to us directly or through Facebook, such as your Facebook photos, any additional photos you upload, your name, age, your chosen interests and activities (under ‘Down To’), and your common Facebook friends with other users. If you swipe ‘down’ to say “yes” to a person, you will be able to chat with that person if they swipe down for you too (when it shows “down to _____ with you.”). When you chat with any user on DownToDash Application, the content of your chat is visible to that user at all times unless you report or block them. Any messages that are undelivered are held on the DownToDash servers until they can be delivered or for a period of 30 days whichever is earlier.

We may share information with third parties that perform and deliver certain services on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, ad tracking and analytics and other features offered through our Service. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

We may disclose your information, in some other situations too. In response to a notice or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency or authority; to establish or exercise our legal rights; to defend against legal claims; prevent misuse or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our application, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement.

How you can access your information

If you have a DownToDash account, you have the ability to review and update your personal information within the Service by opening your account and going to settings and editing your profile.  More information about how to contact us is provided below. You also may delete your account at any time by visiting the “Settings” page for your account. In the event, of deleting your account, your university email id and certain information associated with your account will be retained by DownToDash for analytical purposes and recordkeeping integrity, as well as to prevent fraud, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

How we protect your personal information

We take reasonable security measures to help safeguard your personal information from unauthorized access and disclosure. However there may be occasions when the system may not be completely secure due to reasons such as technological changes, upgrades or any other reasons not specified herein Therefore, although DownToDash shall take steps to secure your information, it does do not guarantee, commit or promise that Your personal information, chats, or other communications would remain secure at all times and the same is at your own risk. Using unsecured Wi-Fi or other unprotected networks to submit messages through the DownToDash Service is never recommended.

Children’s privacy

The DownToDash Application is intended for people who are competent to contract under applicable law. Individuals who are less than 18 years old are not permitted to use this application unless the complete Agreement is seen and agreed by parents or their legal guardians under applicable law. You confirm that you are at least 18 year old or otherwise competent to contract including with consent of your parent/legal guardian as may be required under applicable law.

  Visiting our Service from outside India

If you are visiting our Service from outside India, please be aware that your information shall be transferred to, stored and processed in India where our servers are located and our central database is operated. By using our services, you understand and expressly consent that your information may be transferred to our facilities in India and third parties with whom we share information as described in this privacy policy and consent to be governed by Indian laws for these purposes.

No Rights of Third Parties

This Privacy Policy does not create rights enforceable by third parties.  You agree to comply with all third party privacy policies, if any, applicable to the use of the DownToDash Application or related services. We shall not be responsible for Your use of any third party product and or service including the terms and conditions of such third party product and or service and or violation and infringement of any third party rights, policies, terms and conditions in connection with access, download or installation of the Application.

Changes to this Privacy Policy

This privacy policy maybe revised from time to time. We will notify you by revising the date at the top of the privacy policy that’s available on our website and mobile application. We request you to review this policy periodically to stay aware of changes, if any. Your continued use of the DownToDash Application constitutes your agreement to this Privacy Policy and any amendments/modifications.

Information Shared with Other Users: Other DownToDash users will be able to view information on your profile that you have provided to us directly or through Facebook, such as your Facebook photos, any additional photos you upload, your name, age, your chosen interests and activities (under ‘Down To’), and your common Facebook friends with other users. If you swipe ‘down’ to say “yes” to a person, you will be able to chat with that person if they swipe down for you too (when it shows “down to _____ with you.”). When you chat with any user on DownToDash Application, the content of your chat is visible to that user at all times unless you report or block them. Any messages that are undelivered are held on the DownToDash servers until they can be delivered or for a period of 30 days whichever is earlier.

We may share information with third parties that perform and deliver certain services on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, ad tracking and analytics and other features offered through our Service. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

We may disclose your information, in some other situations too. In response to a notice or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency or authority; to establish or exercise our legal rights; to defend against legal claims; prevent misuse or as otherwise required by law. You also may delete your account at any time by visiting the “Settings” page for your account. In the event, of deleting your account, your university email id and certain information associated with your account will be retained by DownToDash for analytical purposes and recordkeeping integrity, as well as to prevent fraud, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

Using unsecured Wi-Fi or other unprotected networks to submit messages through the DownToDash Service is never recommended.

Children’s privacy

The DownToDash Application is intended for people who are competent to contract under applicable law. Individuals who are less than 18 years old are not permitted to use this application unless the complete Agreement is seen and agreed by parents or their legal guardians under applicable law. You confirm that you are at least 18 year old or otherwise competent to contract including with consent of your parent/legal guardian as may be required under applicable law.

  Visiting our Service from outside India

If you are visiting our Service from outside India, please be aware that your information shall be transferred to, stored and processed in India where our servers are located and our central database is operated. By using our services, you understand and expressly consent that your information may be transferred to our facilities in India and third parties with whom we share information as described in this privacy policy and consent to be governed by Indian laws for these purposes.
